General Terms and Conditions Webshop "079.ch"
1. Basic principles
The following General Terms and Conditions for the Webshop "079.ch" (GTC) of Swisscom (Switzerland) Ltd, Alte Tiefenaustrasse 6, 3050 Bern are exclusively applicable to all offers made and orders placed in this webshop www.079.ch. By completing your order, you confirm that you have read these GTC and expressly agree to them. You also confirm that your personal information (including in particular your email address) is correct and up to date.
2. Offer and prices
All items shown in our webshop are subject to availability.
We may limit the number that can be ordered per customer for items that we produce in limited editions. You will be informed concerning these special restrictions in our webshop. The purchase price is calculated based on the time when your order was placed. All prices are inclusive of VAT, but do not include shipping costs.
Shipping costs are calculated on the basis of the current prices of Swiss Post and displayed to you in the shopping basket before completing the order.
3. Orders
You can select items in our webshop and add them to your shopping cart. By completing your order, you confirm that your order will be binding on you. Please note that orders placed cannot, as a rule, be changed or cancelled (subject however to Section 8 below – Returns).
You will receive an order confirmation by email. If an item offered in our webshop is exceptionally out of stock and not available, we will inform you immediately and refund the amount already paid.
The acceptance of your order and the conclusion of a contract for the purchase of the items between you and us will be deemed to have occurred as soon as you receive confirmation from us that your items have been shipped.
You can sign in to your customer account opened in our webshop before placing an order or alternatively order as a guest. If you have opened a customer account, please note that the login credentials are personal. You must treat your access data (in particular your password) with due care and keep them secure and, in particular, must not share them with third parties. You are responsible towards us for any third party use of the login credentials and in particular for any order placed using your login credentials.
4. Payment
You can pay for your order by credit card, Apple Pay or Google Pay.
5. Deliveries
Delivery shall be made to the shipping address or place of use specified by you and shall normally occur by post. The shipping address or place of use shall be chosen in such a manner that a person can accept the delivery or that access to the place of use is possible and guaranteed.
We always endeavour to hand over the items you have ordered to the Swiss Post within a few working days. If this is not possible, we will inform you concerning the delay by email.
6. Warranty
Please check the items delivered within 8 days for evident material or manufacturing defects and report any such defects to us immediately.
Defects that could not be discovered during a reasonable inspection and that only come to light at a later stage must be reported as soon as they are discovered. If you fail to carry out an inspection or to report immediately a defect that is discovered or comes to light at a later date, the items shall be deemed to have been approved and you may no longer assert any claims against us.
The warranty period for items supplied by us is two years. If any defects come to light during this period and are notified in good time, we may offer to repair the item or to reduce the purchase price. If the above options are not possible, you may withdraw from the contract.
Please also note the washing and care instructions on the product labels. The warranty does not cover any defects attributable to the incorrect or improper handling of our items.
7. Liability
Please note that you may not bring any liability claims against us for direct or indirect losses, including consequential losses, unless the losses were caused by wilful wrongdoing or gross negligence on our part.
8. Returns
If you do not like the items delivered by us, you can return them within 30 days of receipt, enclosing the return form. For this purpose, the items must be complete and in their original packaging and be in unused and undamaged condition. Personalised or custom-made items cannot be returned. Sealed items (such as underwear) may be returned if the packaging has not been opened after delivery.
You are responsible for the costs of return shipment. This does not apply to returns of defective, damaged or incorrectly delivered items. Please obtain confirmation of your return from Swiss Post and retain this confirmation, especially as you can only obtain a refund for a return shipment that has been lost upon presentation of this confirmation.
9. Copyright and ownership
All rights over the images, photographs, text, graphics, videos etc. presented or displayed in our webshop are held by us or our partners. They may not be used without our express consent.
10. Applicable law and jurisdiction
This contractual relationship shall be governed by Swiss law. The place of jurisdiction is Bern. The foregoing is without prejudice to any mandatory place of jurisdiction (cf. in particular Articles 32 and 35 of the Swiss Civil Procedure Code [ZPO] for consumers).
